These Terms and Conditions ("Terms") govern your use of the IntelliHomes Water Damage website at waterdamage.intellihomes.ca and the professional restoration services provided by IntelliHomes Water Damage ("IntelliHomes," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By using our website or requesting our services, you confirm that you are at least 18 years of age, have the legal authority to enter into binding agreements, and accept these Terms in full. If you are acting on behalf of a business or property management company, you represent that you have authority to bind that entity to these Terms.
2. Services
2.1 Scope of Services
IntelliHomes Water Damage provides emergency water damage response, water extraction, structural drying, biohazard cleanup, and property restoration services in Toronto and the Greater Toronto Area, Ontario, Canada. The specific scope of work for each project is defined in a written estimate or service agreement provided prior to commencement of work.
2.2 Emergency Services
For emergency service calls, we will provide a verbal assessment and begin work to prevent further damage as quickly as possible. A written estimate will follow as soon as conditions allow. You authorize emergency work by calling our emergency line and granting access to your property.
2.3 Service Availability
While we strive to maintain 24/7 availability, response times may be affected by extreme weather events, high demand periods, or other extraordinary circumstances. Our quoted response times are targets, not guarantees.
3. Estimates and Pricing
3.1 Free Assessments
Initial on-site assessments are provided at no charge. Written estimates are provided before work commences on non-emergency projects. For emergency projects, a scope of work and estimated cost will be provided as soon as conditions safely allow.
3.2 Final Pricing
Final project costs may differ from initial estimates if the actual scope of damage differs from what was assessable at the time of estimate. We will notify you of any material scope changes before proceeding with additional work. Hidden damage discovered during restoration (behind walls, under floors) may result in revised pricing.
3.3 Insurance-Funded Projects
When work is funded through an insurance claim, pricing is typically governed by the insurer's approved scope and unit pricing. We will work within approved claim amounts and notify you if approved funding differs from the required scope of restoration.
4. Payment Terms
- Payment is due upon completion of services unless otherwise agreed in writing
- For insurance-funded projects, payment is due within 30 days of claim settlement or at project completion, whichever comes first
- We accept e-transfer, credit card, and cheque
- Overdue accounts bear interest at 1.5% per month (18% per annum)
- IntelliHomes reserves the right to place a lien on the property for unpaid services in accordance with Ontario's Construction Act
5. Customer Responsibilities
You agree to:
- Provide accurate information about the damage and your property
- Grant safe and reasonable access to the property during restoration
- Notify us of any known hazards (asbestos, mold, electrical issues) before work begins
- Not interfere with or modify work in progress without written consent
- Contact your insurance provider promptly and provide us with claim information
- Maintain adequate heat in the property during winter months to prevent re-damage
6. Warranties
6.1 Workmanship Warranty
IntelliHomes warrants that restoration work will be performed in a professional and workmanlike manner in accordance with applicable industry standards (IICRC S500 for water damage). We warrant our workmanship for a period of one (1) year from project completion.
6.2 Exclusions
Our warranty does not cover:
- Damage caused by subsequent water events after project completion
- Pre-existing conditions not caused by the water damage event
- Customer-supplied materials or third-party products
- Normal wear and deterioration
- Damage resulting from failure to maintain the property after restoration
7. Limitation of Liability
To the maximum extent permitted by applicable law, IntelliHomes' total liability arising from any claim related to our services shall not exceed the total amount paid for the specific services giving rise to the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages.
IntelliHomes is not liable for delays caused by circumstances beyond our reasonable control, including but not limited to extreme weather, natural disasters, supply chain disruptions, or acts of third parties.
8. Website Use
8.1 Permitted Use
Our website is provided for informational purposes and to facilitate service requests. You may use the website for lawful purposes only. You must not misuse the website, submit false information, or attempt to circumvent security measures.
8.2 Intellectual Property
All content on this website — including text, images, logos, layout, and code — is the property of IntelliHomes Water Damage or its licensors and is protected by applicable Canadian copyright and intellectual property laws. Reproduction without written permission is prohibited.
8.3 Accuracy of Information
We strive to keep website content accurate and current, but we make no warranty as to the completeness or accuracy of any information on this site. Service availability, pricing, and response times described on the website are general guidelines and may vary.
